UPDATE FROM THE APPEAL COURT CASE FOR EXTENTION OF TIME, TODAY SATURDAY 10TH OCT, 2015 AT COURT OF APPEAL , OWERRI IMO STATE.
The hearing of D matter just commenced.
Olanipekun (SAN), is arguing that D court doesn't ve jurisdiction to hear D matter if D pre-trial report isn't b4 them
Chief Awa Kalu, SAN, leading the petitioners' counsel, now arguing his case
P arguing that D appeal fastens on D order made by D #AbiaTribunal and that the Rs knew everything about it and that's what matters
P is arguing that why they are appealing is not the pre-trial order but the application for time extension......... and the application was pending before the #AbiaTribunal before R1 was asked to commence with his case
P says that D application was that 4 days extension be granted them 2 present their witnesses who ve been front loaded
R1 arguing seriously that since D pre-trial report is not made available by P, that D court should strike out D appeal
R1 cites Igbeke vs Okadigbo (2013) to support his case that his lordships dismiss the appeal.
R2, Onyeche Ikpeazu, SAN, and R3, Livy Uzoukwu, SAN, are aligning with R1 to pray the court to strike out the appeal.
P tells D court to check the records that the Rs also took a motion on 27/07/15 after the expiration of pre-trial
J rules that judgement on this appeal is reserved till tomorrow 11/10/15 by 11AM.But Olanipekun is pleading for Monday
After Rs pointing out some laws in D elect act concerning holidays, J rules that judgement is reserved till 12/10/15
The appeal court has adjourned till Monday 12/10/15 (As the court pleases)
